THE Kerrigan family in cult classic The Castle had to argue in the High Court that "a man's home is his castle".
Now Melbourne entrepreneur JAMES FRY will make the pilgrimage to Canberra to defend himself against what he says is classic case of an international hotel chain, Novotel, trying to take the little man down.
Fry's rooftop caravan park is potentially facing financial ruin from legal action by French-owned Accor hotels.
Fry owns Notel, which he says offers guests unique accommodation in the form of six 1970s Airstream caravans on a carpark rooftop on Flinders Lane.
But lawyers for French multinational Novotel claim in court documents filed that the name "Notel"is "deceptively similar"to theirs, insisting there's a "real and tangible danger that the average Australian consumer seeing or hearing the competing marks may be confused or deceived".
In legal documents seen by Page 13, it's also claimed the brands "cover the same or similar services".
Fry told Page 13 he strongly rejected the claims, saying the whole concept of the name Notel is it is "not a hotel". Notel does not offer room service, TV, concierge or a restaurant.
While the Trademark Office initially gave the name the green light, it is now being challenged by Novotel.
Fry says he has had to dump his lawyers because of growing legal bills and will selfrepresent when the matter is heard at Canberra's High Court on July 15. "I feel like DARRYL KERRIGAN in The Castle.
